On 22 July 2026, China's Ministry of Commerce issued a rare sharp-toned response: France's newly enacted anti-ultra-fast-fashion law (loi anti-ultra-fast-fashion), which explicitly names Shein, Temu and AliExpress as primary targets, imposes discriminatory restrictions on Chinese-invested cross-border e-commerce platforms, distorts fair competition under the pretext of environmental standards, and constitutes a trade barrier against China under WTO non-discrimination principles. The statement was not routine diplomacy. It marked the moment when Paris's green legislation stopped being a domestic environmental file and became a China–EU systemic friction point — sitting on top of the EU's €3 low-value parcel duty (1 July 2026), the DSA fines on Temu (€200 m) and AliExpress (€550 m), and a widening Franco-Chinese goods deficit.

The discrimination is not in the words but in the parameters. Left-wing deputies abstained precisely because the calibration tracks Asian platforms, not European fast fashion. The European Commission itself questioned whether the ad ban conforms with EU internal-market law — a sign Paris knows it is stretching the envelope.

The architecture is deliberate: the EU layer taxes the logistics model, the DSA layer taxes the content/recommendation model, the French layer taxes the garment model. The cumulative load does not ban Chinese platforms by decree; it prices the low-price segment out of the French market while leaving Zara's local warehousing untouched.

But the harder truth: even if WTO panels rule for China in 2028–29, the commercial model will have already migrated. French law is not trying to win a dispute; it is trying to expire a business model inside its border before the dispute concludes.

It is the first clean instance where the EU uses climate semantics + digital-services law + customs reform as a combined non-tariff barrier against a specific capital origin, without naming the capital origin in the legal text. For China–EU relations, it signals that the "comprehensive partnership" frame now coexists with a sector-by-sector containment reflex — EVs yesterday, fashion parcels today, likely toys, ceramics and small appliances tomorrow. For China–France relations, the €50.2 bn deficit guarantees that Macron will keep converting bilateral imbalance into regulatory activism, regardless of his pro-multilateral rhetoric.
Trade diplomats used to say "the green transition is a cooperation agenda." Paris in summer 2026 said, in effect: the green transition is also a border tool. That sentence is the real deliverable of the anti-ultra-fast-fashion law.
